Terms of Service

Welcome to Ember — a disposable-camera-for-events app operated by Naachtech (“we”, “us”), contact info@naachtech.com. By using the iOS app or the web invite pages, you agree to these terms. If you do not agree, please don’t use Ember.

1. Who can use Ember

You must be at least 13 years old to use Ember (16 in the EU/EEA/UK). If you are under the age of majority in your country, you may only use Ember with the involvement of a parent or guardian. Ember is not designed for children and we do not knowingly collect data from people below those ages.

2. The two sides of Ember

You can be both, in different events.

3. Acceptable use

You agree that you will not, and will not allow your guests or co-hosts to:

Hosts are responsible for the photos taken at events they create — including guests’ photos. If you wouldn’t want a photo on your phone, don’t host an event where guests will take it.

4. Moderation and reporting

We review reports of objectionable content within 72 hours and remove violating content. We may remove users who repeatedly post violating content.

Anyone viewing a developed roll — host or guest — can tap the flag icon on a photo to report it. Reports go directly to info@naachtech.com. Hosts can also remove any photo from their event roll and block a guest from continuing to participate, from inside the iOS app.

For copyright takedowns and other rights-based complaints (DMCA-style), email info@naachtech.com with the event link, the specific photo, and a description of the issue.

5. Your content, your licence to us

You keep all rights to the photos you upload. By uploading a photo to an event, you grant Naachtech a non-exclusive, royalty-free, worldwide licence to store, transmit, and display that photo to other people invited to the same event, for the lifetime of the event and a reasonable archival window afterwards. This licence exists only so we can run the service — we do not licence your photos to anyone else, we do not use them to train models, and we do not show them outside the event.

If a host enables the public roll setting for an event, the licence above extends to displaying those photos on the event’s public reveal page. Hosts control this setting; it is off by default.

6. Account termination

You can delete your account at any time from Settings → Delete account in the iOS app. This permanently removes your account, every event you’ve hosted, and every photo guests took at those events.

We may suspend or terminate your account, an individual event, or a guest’s ability to join an event if we reasonably believe you or someone using your invite has violated these terms. For clear violations (such as illegal content) we may act immediately and without prior notice; in less clear cases we’ll usually contact you first.

7. Service availability

Ember is provided on an “as is” and “as available” basis. We make no guarantee about uptime or that photos will develop within a particular window. If the service is unavailable when an event is meant to start or end, please be patient — we will not be liable for delays in developing or revealing photos.

8. Liability

To the maximum extent allowed by law, Naachtech is not liable for indirect, incidental, consequential, special, or exemplary damages arising from your use of Ember. Our total liability for any direct loss arising from Ember is limited to the greater of (a) the amount you paid us for Ember in the twelve months before the claim — currently $0 — or (b) US $50.

Nothing in these terms limits liability that cannot be limited under your local law.

9. Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Disputes will be brought in the state or federal courts located in San Francisco County, California, unless your local consumer-protection law guarantees you a different forum.

10. Changes

We’ll update the date at the top of this page when we change these terms, and surface a notice in the app for material changes before they take effect. Continued use after a change means you accept the new terms.
